No, she should not! Nor will she be! Why not? Because President Obama and his Department of Justice will not let it happen!
She did make a big mistake and was late to apologize. We can even say her initial denial was worse than the “crime” itself. But indicting her now to virtually throw her out of the Presidential race is like indicting you, a regular citizen, on a speeding ticket, knowingly given to you on your way to your wedding for driving 60 in a 55 zone! A justice unacceptable to most Americans!
In short, the GOP must compete on ideas, not by being overly obsessed with Clinton’s emails!
1. Understanding the American Presidency
All of recent American Presidents have obviously worked for two paramount purposes:
- Throughout the first term: getting re-elected ad nauseam. Both Presidents Bush and Obama proved that, with Iraq being an extreme example. For more, read: American Presidency: Why is One-Term a Must (Version 3)?
- Throughout the second term: preserving their legacy ad nauseam!
Who is more likely to best preserve President Obama’s legacy (e.g. Obamacare) – Bernie Sanders or Hillary Clinton? The latter, of course! So he will do everything, anything, possible to help her win both the primary and general elections!
What then can he do to best help her? Inaction on a possible indictment!
2. Understanding America’s legal system
Americans revere the rule of law (Democracy and Freedom), often without recognizing that our legal system is severely flawed. For example, more than 1% of our population is in jail (with a huge percentage of minorities), more than any other country on earth (World Prison Brief)!
Another fact about our legal system: almost any American can be indicted anytime for one of the following two reasons:
- Speeding tickets: Most Americans drive above the speed limit. The police can pick and choose to stop nearly anyone, issuing tickets at will!
- Tax: Many Americans are imperfect in tax filing. It has been used by the government to target any individual as it sees fit, with an extreme example being Al Capone.
Despite the fact that Americans, generally speaking, have a good sense of justice, our jury system is very flawed, with an extreme example being the O. J. Simpson murder case.
3. Understanding American politics
Most candidates seeking public offices try to win, or try to get re-elected, ad nauseam, including telling lies and politicking everything possible to their advantage!
Now, why did not Bernie Sanders use the Clinton email issue to his advantage (The Latest: Sanders says don’t politicize Clinton emails)? He knows it’s a risky thing to do with his primary constituents. Additionally, aim high – Bernie needs those Clinton voters in the general election!
In contrast, why can’t the Republican candidates get enough of it? They are desperate in the hugely contentious primary election, with the leading candidate Donald Trump going extra miles (e.g. insulting Hispanics, Muslims, Hillary Clinton on emails), in order to secure his nomination, at the cost of losing the general election by further alienating many independent voters (Donald Trump and His Presidential Campaign)!
4. Secretary Hillary Clinton vs. General David Petraeus
Here is how some Republicans compare Secretary Hillary Clinton with General David Petraeus: Trump and Bush agree: Clinton worse than Petraeus.
This comparison is not completely valid for two main reasons:
- General Petraeus carried on an extra marital affair and knowingly let his mistress access some classified information. Secretary Clinton mixed private and public emails, like many of her predecessors did.
- Timing is everything! General Petraeus was caught and fined, with little consequence to the country in the large. In contrast, if Presidential candidate Hillary Clinton is indicted now, it will directly impact the election at hand, perhaps even resulting in a civil war!
5. Secretary Hillary Clinton vs. President George W. Bush

6. Timing is everything!
Even for justice! Two examples:
- President Gerald Ford: He chose to pardon his predecessor Richard Nixon for the sake of the country, although his action almost immediately made himself not re-electable!
- Chief Justice John Roberts: Twice he had a chance to overturn Obamacare but chose not to – I am with him! As an independent with a Republican-leaning voting record, I was very critical of Obamacare initially (e.g. The America That Can No Longer Think, Politically). However, after it became law, I accepted it because overturning it would be much more costly than keeping it and improving it over time, hopefully!
“Politics is the art of the possible, the attainable – the art of the next best.”
Bottom line: Did Hillary Clinton make a mistake with her emails? Yes, big time! Is her mistake big enough to change the fundamentals of our political system at this critical time, including the possibility of provoking a civil war? No!
7. Closing
The GOP must not conduct a negative campaign, such as pushing and betting on an indictment of Hillary Clinton in 2016 – It will not happen!
The GOP must pick the best candidate who can not only possibly win the general election, but also govern as the President! I have already endorsed John Kasich (The 2016 GOP Ticket: Kasich-Martinez!). With the latest endorsement from New York Times (The New York Times endorses Clinton, Kasich), Kasich will dramatically improve his chance, fast, hopefully!
